ERS’ search of an individual’s worker’s compensation history allows a company to determine if an applicant has filed worker’s compensation claims and identify injuries that could prevent someone from performing specific job requirements. These searches reveal types of claims, dates of filings, and employers on record at time of any injury. This search is not available in all states and can only be requested after an offer has been made or post-hire.
Using information from one of the nation’s three leading credit bureaus, ERS’ credit reports can identify credit histories of a potential employee. These searches would reveal if this individual possesses accounts in bankruptcies or collections, judgments, any open loans, tax liens, third party inquiries, accounts paid according to terms, negative accounts paid or charged off, and existing active accounts including revolving credit lines. Wherever allowable under federal and state laws, and conducted under compliance guidelines from the Fair Credit Reporting Act (FCRA), credit histories can be of special interest for evaluating job applicants who will have access to, or be responsible for, financial assets, transactions and decisions within an organization.
As an alternative to credit reports, ERS can conduct searches of bankruptcy filings within any of the 94 judicial district courts within the United States. Our searches return records for Chapter 7 and Chapter 11 filings. These searches help identify potentially risky candidates and avoid negligent hiring, especially for individuals placed in positions with access to financial information, funding and other highly-sensitive information. Searches include file date and type, adjudication date, and status.
Child Abuse Registry searches must be conducted on a state-by-state basis. Not all states have a central registry, and not all records can be accessed as per state and federal statutes. Certain professions and licenses do require that an individual be screened against a specific state’s registry for approval. When permitted, ERS searches all states referenced by a job applicant and with the applicant’s written permission. In states where registries are in effect, individuals listed have been designated by a family or criminal court as having abused or neglected a child. These registries often also list abuse investigations currently in effect. Because these registry records are frequently confidential through a state’s Department of Social Services (DSS) by state and federal statute, they can only be accessed by law enforcement or via written consent by a job applicant.
For elderly abuse registries, ERS searches state-by-state for individuals identified by state adult protective service agencies who are known to have committed abuse of seniors over 60 years of age and adults with disabilities over age 18. As with the Child Abuse Registry, not all states allow accessibility to these records per state and/or federal statutes. When available, access to these registries are designed to significantly limit access an individual has to securing employment in the healthcare arena including at long-term care and assisted living facilities, and with home health care providers. A comprehensive search and screening by ERS helps ensure all patients’ safety, protects an organization’s reputation and brand, and helps avoid costly litigation and fines. This screening can also help an organization comply with their state’s regulatory requirements.
